Colorado ranks in the top ten states for numbers of foreclosures. The states economy has been hard hit by the mortgage crisis. The hardest hit communities are in and around the metro areas and there are some real bargains available. This is not a simple task because there is no definitive list of all the homes in distress. The best deals are on those homes that have not yet gone up for sale by the public trustee. The best bargains are at the foreclosure sales but it takes know how and determination to submit a winning bit on the home You want.

It all starts when the loan company files a Notice of Election and Demand against the property in default. This gives the owners not less the 110 days and not more than 125 days to arrange a method to redeem their property. Many folks will try to sell their home during this period while their attorney tries to structure a “Short Sale” where they will try to get the lender to settle for something less than the loan amount. If all fails then the property is foreclosed and the public trustee proceeds with the sale. During this time any interested party can drive by the home and look. The owners do not have to give You access so there may be a problem getting in to view the house.

 

THE DAY OF THE SALE

 

Two days prior to the sale date the lender must submit their bid amount and it is available at the public trustee’s office. You can then bid what ever amount You want above the lenders amount. The home goes to the highest bidder. This is a basic outline of the process but in reality it is more complicated.
