DEEDS OF TRUST FOR EVERGREEN COLORADO REAL ESTATE

 

One of the newer types of deeds used in Colorado is the Deed of Trust. The Deed of Trust is a legal instrument which takes the place, and serves as a further guarantee for the mortgage lender, whereby the legal title to real property is put in a trust controlled by the County Trustee to secure the repayment of the mortgage or the performance of other conditions. Although it is some what different from a mortgage it serves the purpose of securing the rights of the mortgage holder.

 

The reason the Deed of Trust became popular was to legally defeat the right of redemption a property owner had under the old mortgage system. If a lender foreclosed on an owner, the owner still had a Right of Redemption which could last up to a year. In a foreclosure the new owner did not have full control of the property and could not sell the property and issue a warranty deed to the buyer, because the original owner still had full rights to buy back the property. So the lender owner could not sell the property and even a lease was subject to the Right of Redemption of the former owner.

 

Under the Deed of Trust the trustee takes full control of the property upon default and the Bank or Mortgage lender immediately assumes full rights of ownership. The mortgage crisis of the last few years has demonstrated the blessings and curses of the Deed of Trust system of property ownership.

We should require all our government institutions to balance their budgets and forbid them to borrow money. We must weigh the cost before committing ourselves and our future to unneeded debt.

Most recently, is the Cash for Clunkers program, we all see how well that turned out.  Yes, while it may be good for the purchaser, the car dealerships are the ones holding the bag, not to mention there are not as many used cars to purchase for people who cannot afford new ones because they are being crushed.  Car dealerships are also not getting paid quickly enough.  The government says it needs to hire more people to process the claims. Then why did they not anticipate these things prior to instituting the program?

 

Fannie and Freddie are two of the government’s secondary home purchasing agencies and they, along with the banks, put us in the housing crisis we have today.  Senators on Capitol Hill decided that more people should have the ability to purchase homes and with that, they instructed the banks to make loans to people whose credit was risky and really could not afford them. When these people defaulted on their loans, the Senators took no responsibility for their action but rather, laid it solely on the banks.  Thus we have the housing crisis.

 

As we can see, anything the government touches it ruins.  It should stick to what its original intent in the Constitution is and that is to protect us and our freedom and nothing else.
