The Statue of Frauds states that no civil action can be brought against another unless there is some document signed by the party against who the law suit is to be filed. The contract must identify the parties, define the subject matter of the agreement, state the agreed terms and conditions, state the consideration of both parties, and be executed (signed) by all parties involved.
Many time while I am showing a home or parcel of land the seller will agree, or make a statement, like the refrigerator is included, or the window curtains, they will pay for the septic engineering and permit, or the listing agreement includes a home warranty; all these promises must be in the final contract, and in writing, or you will have bought an empty promise. Make no presumptions, assume no good motive, and get it in writing.
