Home sales rose 7.6% in April as first time home buyers cashed in on Uncle Sam’s tax credit. The tax credit expired on April 30th when your new home needed to be under contract. The closing, however, could take place after the April 30th deadline.

 

NAR (the National Association of Realtors) is predicting a drop in home sales as we head into the summer months and the tax incentive is no longer available. The basics of the market are still unstable and unemployment continues to climb. Consumers are wary as incomes drop and cost, especially taes, go up.

RECORDING YOUR DEED WITH THE COUNTY CLERK

 

There is an old right is most states which allows a person to gain superior rights to a property, or an easement over a piece of land by having actual, notorious, hostile, visible, and continuous possession to a real estate right for the required amount of time (in Colorado it is 18 years). This right is called Adverse Possession. By recording your deed at the county clerk’s office you give the world “constructive notice” or “legal notice” that you own the land, and nobody can adversely squat on your legally owned property. It provides a conclusive presumption that all persons do have, or should have knowledge of recorded legal instruments.

 

It is also a good idea to openly defend You rights to any property. If someone is encroaching on Your land and you are willing to allow it, You should send a registered letter with a return receipt, or give legal service to the party stating that they are trespassing at Your sufferance and that their violation is not “actual and hostile” but with your permission.

 

Today, with Title insurance and complicated involved real estate closings, we are seduced into thinking that all is well. Although there are many protections, remember that You are the primary defender of your rights and, by law; you must defend your ownership against any real or perceived hostile rights or claims against your title. These may come in the form of home owners association, condo owners, neighbors trespass, or government roads and public access.
